Geek Club Subscription Service Terms and Conditions

1. Subscription

By subscribing to the Geek Club Subscription Service (“Service“), you agree to be bound by these Terms and Conditions. The Service is provided by Geek Group Pty Ltd (“Company“, “we“, “us“, “our“). Your agreement to these Terms is deemed to occur upon purchase of the Service. If you do not agree to be bound by these Terms, you must not purchase or use the service.

2. Membership Perks

Members of the Service will receive the following benefits:

2.1. 20% off our standard service rates for both remote and onsite services.

2.2. 50% off the Company recommended retail price (RRP) of selected antivirus software: Malwarebytes, Trend Micro, and Norton.

2.3. Access to our dark web monitoring platform, designed to alert you to leaked passwords.

2.4. Free access to Backupper backup software for Microsoft Windows Operating Systems 7,8,8.1,10 and 11.

2.5. Access to our AI GeekBot for assistance with small IT inquiries.

2.6. Priority support, which includes a dedicated support email address and ticket system.

3. Subscription Fee, Scope and Additional Services

3.1. The annual fee for the Service depends on the type of subscription:

3.1.1. Geek Club Home: $199 per year. This subscription is applicable for a single household address and can be used by all members residing at that address. Dark web monitoring will cover one single email address. Additional emails can be monitored for a cost of $30 per year per additional email.

3.1.2. Geek Club Business: $399 per year. This subscription applies to a single business entity and can be used by all staff members of that business. Dark web monitoring will cover all email addresses under the business domain. Additional personal emails can be monitored for a cost of $30 per year per additional email.

3.2. The subscription fees and any additional service fees are payable in advance and are non-refundable in whole or in part. By subscribing to the Service and any additional services, you agree that you will pay the applicable fee.

3.3. These fees may be subject to change, and we reserve the right to alter these fees with prior notice to you.

3.4. Misuse of the subscription, including but not limited to sharing the subscription benefits outside of the specified household or business entity, may result in the immediate termination of the subscription without refund.

By subscribing to the Geek Club Service, you confirm that you have read, understood, and agree to these Terms and Conditions in their entirety. If you do not agree to these Terms, you must not subscribe to or use our Service.

4. Limitation of Liability

While we strive to offer high-quality service and reliable perks, to the maximum extent permitted by law, we are not liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever, arising out of or in any way connected with the use or performance of the Service. This includes but is not limited to damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Service, the delay or inability to use the Service, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Service.

5. Warranties and Disclaimers

The Company will not be liable for any losses and damages in connection with the use of the Service.

6. Indemnification

You agree to indemnify and hold the Company, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of these Terms and Conditions and/or arising from a breach of these Terms and Conditions and/or any breach of your representations and warranties set forth above.

7. Termination

The Company reserves the right to terminate your access to the Service at any time, with or without notice, for any violation of these Terms.

8. Changes to the Terms and Conditions

We reserve the right to amend or update these Terms and Conditions from time to time. It is your responsibility to regularly check these Terms for any changes. If you continue to use the Service after any changes to the Terms, you are deemed to have accepted those changes.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Queensland, Australia. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

By subscribing to the Geek Club Service, you confirm that you have read, understood and agree to these Terms and Conditions in their entirety. If you do not agree to these Terms, you must not subscribe to or use our Service.

10. Subscription Cancellation, Refunds, and Renewals

10.1. Cancellation: You may cancel your subscription to the Service at any time. If you choose to cancel your subscription, the cancellation will take effect at the end of the current subscription period. You will continue to have full access to the Service for the remainder of your prepaid subscription period.

10.2. No Refunds: Payments for subscriptions are non-refundable, and there are no refunds or credits for partially used subscription periods. Following any cancellation, however, you will continue to have access to the Service through the end of your current subscription period.

10.3. Automatic Renewal: Unless you cancel your subscription before the end of the current subscription period, your subscription will automatically renew for another term of the same duration. You authorize us to charge your payment method for the renewal term. You will be notified of any price changes prior to renewal.

11. End of Subscription Term

At the end of your subscription term, if not renewed, your access to the Service and all member benefits will cease. We are not responsible for any data loss, including backup data or dark web monitoring alerts, after the end of your subscription term. It is your responsibility to take any necessary precautions regarding your data prior to the end of your subscription.

12. Priority Support

12.1. As part of the Service, subscribers are provided with Priority Support. Priority Support refers to the commitment from the Company to respond to and resolve your service requests faster than non-subscribers.

12.2. Priority Support includes access to a dedicated support email and ticket system exclusive to subscribers of the Service. The Company will use reasonable efforts to prioritize responses to these communication channels over non-subscribers’ requests.

12.3. While we aim to provide timely and effective support, Priority Support does not guarantee immediate responses or resolution times. The Company makes no warranty that every request will be resolved within a specific timeframe.

12.4. Priority Support is available only to active subscribers of the Service. If your subscription is cancelled or has expired, you will lose access to Priority Support.

13. Anti-virus Software Liability

13.1. While we offer discounts on select anti-virus software as part of our Service, we are not the manufacturers or providers of these software products. As such, we are not responsible for any damages or losses that you may suffer as a result of using, or failing to use, any of these anti-virus software products.

13.2. The use of any anti-virus software should be in accordance with the terms and conditions of the respective software provider. We recommend that you review these terms carefully.

13.3. You understand and agree that your use of any anti-virus software obtained through our Service is at your sole risk and discretion. You will be solely responsible for any damage to your computer system or loss of data that results from the download or use of any such material or service.

14. Backup Software Liability

14.1. As part of our Service, we offer free access to Backupper backup software. We are not the manufacturers or providers of this software, and as such, we are not responsible for any damages or losses that may result from the use, or failure to use, this backup software, including but not limited to any loss of data.

14.2. The use of the Backupper software is subject to the terms and conditions of the respective software provider. We recommend that you review these terms carefully before using the software. By using the software, you agree to these terms and the terms of the software provider.

14.3. You acknowledge and agree that it is your responsibility to ensure that your backups are functioning correctly. We strongly recommend that you regularly check your backups and, in case of any doubt, you may utilise our services to verify that the backups are set up correctly.

14.4. Any use of the Backupper software is at your sole risk and discretion. You will be solely responsible for any loss of data or damage to your computer system that may occur as a result of using this software.

15. Dark Web Monitoring Liability

15.1. As part of our Service, we offer a Dark Web Monitoring platform. This platform aims to alert you to any leaked passwords detected on the dark web. However, we make no guarantee or warranty that this monitoring service will find or detect all information leaks.

15.2. We are not responsible for any damages or losses that may result from the use, or failure to use, this Dark Web Monitoring service, including but not limited to any financial loss, identity theft, or any other type of data breach.

15.3. The use of the Dark Web Monitoring platform should be seen as a preventative measure and not as a comprehensive security solution. You understand that it is your responsibility to secure your online accounts and personal information.

15.4. You understand and agree that your use of the Dark Web Monitoring service is at your sole risk and discretion. We are not liable for any loss or damage that may occur as a result of the detection or lack of detection of any information by the Dark Web Monitoring service.

16. GeekBot Usage and Liability

16.1. Our Service includes access to GeekBot, an artificial intelligence (AI) powered knowledge base. GeekBot is designed to learn new information constantly and assist with small IT questions.

16.2. However, as an AI, GeekBot’s responses are generated based on its programming and training data, and we cannot guarantee the accuracy or applicability of its responses to your specific situation. We are not responsible for any damages, losses, or issues that may arise from following advice or information provided by GeekBot.

16.3. GeekBot is provided to subscribers for fair use only. Misuse, including but not limited to excessive or automated requests, may result in limitations on your use of GeekBot or the termination of your subscription.

16.4. GeekBot is for the exclusive use of our subscribers. Sharing access to GeekBot outside of your household (for Geek Club Home subscribers) or business entity (for Geek Club Business subscribers) is considered misuse and may result in immediate termination of your subscription without refund.

17. Discount on Service Rates

17.1. As part of our Service, Geek Club subscribers are eligible for a 20% discount on both our remote and onsite service rates.

17.2. Our standard onsite service rate is $139 per hour, which will be discounted to $111.20 for Geek Club subscribers. Our standard remote support session rate is $99, which will be discounted to $79.20 for Geek Club subscribers.

17.3. This 20% discount applies solely to the labor cost of remote and onsite services provided by us. It does not apply to the cost of parts, hardware, or other services.

17.4. Misuse of the discount, including but not limited to applying the discount to ineligible services or products, may result in the immediate termination of the subscription without refund.

18. Discount on Anti-virus Software

18.1. As part of our Service, Geek Club subscribers are eligible for a 50% discount on the Company recommended retail price (RRP) of select anti-virus software, namely Malwarebytes, Trend Micro, and Norton.

18.2. This discount is subject to the availability of the software. In the event that a specific anti-virus software is not available, we reserve the right to substitute it with another similar anti-virus software.

18.3. Misuse of the discount, including but not limited to applying the discount to ineligible software or products, may result in the immediate termination of the subscription without refund.

19. Privacy Policy

19.1. By subscribing to the Geek Club Service, you agree to our Privacy Policy, which is available for review at https://supergeek.com.au/privacy-policy. The Privacy Policy explains how we collect, use, disclose, and protect your personal information. It is incorporated by reference into these Terms and Conditions.

19.2. We recommend that you read our Privacy Policy carefully before subscribing to our Service. If you do not agree to our Privacy Policy, you must not subscribe to or use our Service.
